Licensing Terms

By visiting and/or taking any action on OnlyDMCA, you confirm that you are in agreement with and bound by the terms outlined below. These terms apply to the website, emails, or any other communication.

These Terms apply in full force and effect to your use of this Website and by using this Website, you expressly accept all terms and conditions contained herein in full. 3. Refund Policy

Only annual subscriptions shall be issued a refund. The client must request a refund no later than 10 days after payment has been received and OnlyDMCA services have not been used.

Creators must reach out to the OnlyDMCA Support Team through official channels to request a refund. If the request for the refund has been approved, you will receive an email confirmation with the amount to be refunded. This refund process could take a minimum of 10 (ten) business days to process and shall be credited to the payment method used upon purchase.

Examples where refund is not applicable:

• Payments made using coupon codes
• Monthly subscription
• When an ISP/OSP accepts a valid DMCA Takedown counterclaim
• If the jurisdiction of the ISP/OSP does not follow DMCA policy or enforces the copyright infringement act
• Guardian Angel Gift Purchases

* ISP stands for Internet Service Provider, while OSP stands for Online Service Provider. Both ISP and OSP are entities that provide access to the internet or other online services, respectively.

4. Auto-Renewal

Monthly and annual subscriptions otherwise known as a Premium Membership will auto-renew until the service has been canceled. A confirmation of renewal will be sent in the form of an email receipt specifying the amount that has been invoiced.

Add-on Renewal

Add-ons made to a client’s plan are to be charged at a pro-rated amount dependent on the number of days remaining before their billing cycle renewal date. If both their Premium Plan & add-on auto-renewal is on, they will be charged at the full amount for the add-on service at their billing date. Add-ons cost $5 USD per keyword. Clients have the ability to cancel their add-on subscription at any time. Clients with annual Premium discounted plans are charged for the complete year.

5. Restrictions

You are expressly and emphatically restricted from all of the following:

publishing any Website material in any media;

selling, sublicensing and/or otherwise commercializing any Website material;

publicly performing and/or showing any Website material;

using this Website in any way that is, or may be, damaging to this Website;

using this Website in any way that impacts user access to this Website;

using this Website contrary to applicable laws and regulations, or in a way that causes, or may cause, harm to the Website, or to any person or business entity;

engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this Website, or while using this Website;

using this Website to engage in any advertising or marketing;

6. Cancellation

You can cancel your OnlyDMCA Premium membership at any time, and you will continue to have access to the OnlyDMCA service through the end of your billing period. To the extent permitted by the applicable law, payments are non-refundable and we do not provide refunds or credits for any partial membership periods.

7. No warranties

This Website is provided “as is,” with all faults, and OnlyDMCA makes no express or implied representations or warranties, of any kind related to this Website or the materials contained on this Website. Additionally, nothing contained on this Website shall be construed as providing consult or advice to you.

8. Limitation of liability

In no event shall OnlyDMCA , nor any of its officers, directors and employees, be liable to you for anything arising out of or in any way connected with your use of this Website, whether such liability is under contract, tort or otherwise, and OnlyDMCA , including its officers, directors and employees shall not be liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.

9. Indemnification

You hereby indemnify to the fullest extent OnlyDMCA from and against any and all liabilities, costs, demands, causes of action, damages and expenses (including reasonable attorney’s fees) arising out of or in any way related to your breach of any of the provisions of these Terms.

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

11. Variation of Terms

OnlyDMCA is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review such Terms on a regular basis to ensure you understand all terms and conditions governing use of this Website.

12. Assignment

OnlyDMCA shall be permitted to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification or consent required. However, .you shall not be permitted to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

13. Entire Agreement

These Terms, including any legal notices and disclaimers contained on this Website, constitute the entire agreement between OnlyDMCA and you in relation to your use of this Website, and supersede all prior agreements and understandings with respect to the same.

14. Governing Law & Jurisdiction

These Terms will be governed by and construed in accordance with the laws of the Province of Quebec, and you submit to the non-exclusive jurisdiction of the provincial and federal courts located in Quebec for the resolution of any disputes.

15. Loyalty Giveaway

Giveaway Period

• The giveaway begins Thursday, December 15, 2022 at 3:00 P.M. Eastern Time (“ET”) and will reoccur every month

Prizes

• There will be four (4) prizes of $500 USD to be won every month. Unclaimed prizes will be added to the next giveaway, until a winner has been declared

Eligibility

• Participants must be 18+ years old and be a current subscriber to OnlyDMCA Piracy Protection Service
• Subscriber must have a minimum of 3 consecutive monthly automatic recurring subscription or subscribers that purchased a 1 year subscription plan with their recurring subscription enabled
• Guardian Angel subscriptions are excluded

General

• Only 1 entry per subscriber
• The winner will be announced live on Instagram on the day of the giveaway (Instagram is in no way associated with this giveaway)
• The winner must be present during the giveaway to win, and has to correctly answer a skill-testing question to claim the prize
• Unclaimed prizes are to be added to the next giveaway
• Prizes will be added to the winner’s OnlyDMCA Affiliate Wallet, payout via PayPal
• Payouts are in USD currency and are to be distributed 7 business days after the giveaway
• OnlyDMCA reserves the right to cancel, suspend, amend or terminate the giveaway at any time, and to also determine eligibility of All participants

16. Referral Program – “Refer & Earn”

OnlyDMCA’s Referral Program, also known as “Refer & Earn” allows users to earn 10% from the earnings of their sign-ups that used their referral link. The 10% is for any payments using their referral, or by guardian angel funds associated with that referral. No time limitations. Payouts are sent in USD currency through the PayPal payment method. After withdrawing the funds, OnlyDMCA has 30 days to process and send the payment to the PayPal account on file. Users are responsible for entering the correct payout information.

Payout percentages are determined by OnlyDMCA and can be changed at their discretion. OnlyDMCA reserves the right to withhold payout and to disable the referral program for any user. OnlyDMCA may deny any vanity domain at its own discretion.

Users who cancel their plan and/or with deleted accounts on OnlyDMCA have a possibility to claim their earnings in their wallets. Deleted accounts must contact help@OnlyDMCA.com for assistance to withdraw. If a user joins without the usage of a referral link, if they were sent a link, the referrer or referee should contact help@OnlyDMCA.com with the necessary details.

Users may not use their referral link to create multiple accounts for themselves. Agencies that pay for their models cannot earn the 10% referral rate on those accounts. Users with wallet funds that have been associated to a referee chargeback may see these funds removed from their wallets until a resolution with the issuing bank has been done. It is also possible to see a negative wallet balance should funds be withdrawn prior to a chargeback of the payment from your referral.

17. OnlyDMCA Add-ons

Add-ons allow users to customize their main scan keywords. OnlyDMCA reserves the right to remove invalid results, turn off add-ons and adjust scan keywords at their discretion. OnlyDMCA is not liable if a scan keyword does not return results, clients have a responsibility to research and request recommendations of scan names before using this feature.
